1. INTRODUCTION

These Terms of Service ("Terms") govern your access to and use of the "Prism - Trusted AI Digest" mobile application ("App"), provided by Ogy Digital Ltd ("Company," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. SERVICES AND AI DISCLAIMER

2.1 Service Description: Prism aggregates and summarizes news articles and generates educational content using artificial intelligence technologies.

2.2 AI Usage & Accuracy: The App utilizes third-party AI services, including OpenAI (GPT-4), to generate content. While we strive for accuracy, AI-generated content may inadvertently contain errors, inaccuracies, or "hallucinations." You acknowledge that the information provided by the App is for informational purposes only and should not be relied upon as professional advice. You are responsible for verifying any information obtained through the App before taking action based on it.

3. ACCOUNTS AND REGISTRATION

3.1 Account Creation: To access certain features, you must register an account using Email, Google Sign-In, or Apple Sign-In. You agree to provide accurate and complete information.

3.2 Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3.3 Age Restriction: The App is intended for users who are at least 13 years of age. By using the App, you represent and warrant that you meet this age requirement.

4. SUBSCRIPTIONS AND PAYMENTS

4.1 Subscription Plans: The App offers a "Freemium" model with optional paid subscriptions (e.g., Monthly Pro Plan) and potential one-time purchases (e.g., Lifetime Access).

4.2 Payment Processing: All payments are processed through the Apple App Store or Google Play Store (via RevenueCat). We do not directly collect or store your payment information.

4.3 Automatic Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current subscription period. Your account will be charged for renewal within 24-hours prior to the end of the current period.

4.4 Cancellations: You can manage and cancel your subscriptions by going to your App Store or Google Play account settings after purchase. Cancellation will take effect at the end of the current billing period.

4.5 Refunds: All refund requests must be directed to the Apple App Store or Google Play Store, as per their respective refund policies. We do not have the ability to process refunds directly.

5. INTELLECTUAL PROPERTY

5.1 App Content: The design, code, and original content of the App are the property of Ogy Digital Ltd and are protected by copyright laws.

5.2 Summaries: We claim copyright over the unique creative expression in our AI-generated summaries and curations. We do not claim ownership of the original source articles linked or referenced within the App based on fair use principles for commentary and educational purposes.

5.3 License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

6. PROHIBITED CONDUCT

You agree not to use the App to:

  • Violate any applicable law or regulation.
  • Infringe upon the rights of others.
  • Upload invalid data, viruses, worms, or other software agents.
  • Attempt to reverse engineer or compromise the system integrity or security of the App.

7. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

8. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, OGY DIGITAL LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ANY CONTENT PROVIDED BY THE APP.

9. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after any such change constitutes your acceptance of the new Terms.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws applicable to Ogy Digital Ltd, without regard to its conflict of law provisions.
